The Navi Mutual Fund App is made available by Navi Technologies Private Limited (“our”, “us”, “we”, “Company”), having its registered office at 3rd Floor, Salarpuria Business Center, 93, 5th A Block, Koramangala Ind Layout, Bengaluru – 560 095, Karnataka, India, through which Navi AMC Limited (formerly known as Essel Finance AMC Limited) shall provide the Services to you. In order for facilitating the AMC Services and for AMC to provide the Services to you, we (i.e., the Company) and Navi AMC Limited (formerly known as Essel Finance AMC Limited) (the “Navi AMC” ) need to collect various data and information from you. The manner in which this data and information is collected, retained, shared, stored and processed by us is addressed in this Navi AMC Privacy Policy(“Policy”). We may revise this Policy as well as update the Services and the App from time to time, so please keep visiting this page regularly to take notice of any changes we make. If you do not agree with any part of this Policy, please stop using our Services immediately.

Services for the purposes of this Policy shall mean enabling online transactions in schemes of Navi Mutual Fund through the App

This Policy, incorporates, and includes our Terms of Use accepted by you for the purpose of making investments on the App (“Terms”) Words and phrases not defined in this Policy shall mean the same as provided in the Terms. All references to you (as a user / visitor) shall include references to all joint-investors, if any and as and when enabled on the App.

What data is collected?

By using the App, you consent to providing Us and Navi AMC us and Navi AMC data in the ways listed in this Policy. We collect data from you for the purposes of complying with applicable law and to ensure that we can provide you Services in the best manner possible. Data collected may include name, title, company, address, phone number, email address, bank details, income details, your photograph, your verification video, proof of address(voter id, passport, driving license, aadhar card) and other relevant data. We also collect other information such as the questions or comments submitted by you.

How is the data collected used?

We collect and use the data collected for the following purposes:

  • for enabling the App and the Services;
  • for processing your investment applications and KYC authentication;
  • redemption on the investments made by you;
  • enabling customer support;
  • research and development;
  • enabling communications between you and us and/or Navi AMC;
  • marketing and outreach;
  • automated decisions, legal compliance, product innovation;
  • enabling you to download product information, order products and take advantage of certain other features of the App;
  • provide information or interactive services through the App;
  • seek your feedback or to contact you in relation to the Services
  • to administer or otherwise carry out our obligations in relation to any agreement you have with us
  • to create products or services that may meet your needs.
  • to process and respond to requests, improve our operations, and communicate with visitors about our products, services and businesses; and
  • to allow you to subscribe to our news letter.
How do we share the collected information?

We are very protective about your data. We may enter into data-sharing agreements or disclose the collected data in order to provide the Services and new product offerings to you. We have detailed the manner in which we and Navi AMC share the collected data below.

  • Validating and authenticating your employment status, employment information and employment duration.

Third Party Services: The App may allow you to connect with other websites, products, or services that we don’t have control over (for example, if we allow you to pay through an external wallet facility then we will have to share your usage information with the facility provider). However, usage of such third-party services is subject to their privacy policies and not within our control. We recommend that you have a look at their privacy policies before agreeing to use their services.

Affiliates and Group Companies: Subject to applicable law, we may share any data we have collected or collect from you with our affiliates and group companies for product research and development, marketing outreach and advertising relevant products to you, and to tailor the products for your benefit.

ii.Sharing with law enforcement when neededIf any governmental authority or law enforcement officers request or require any information and we think disclosure is required or appropriate in order to comply with laws, regulations, or a legal process.
What are your rights regarding the data?

Marketing opt-outs: We may email and notify you from time to time about our or our affiliates’ and groups’ latest offerings and updates. You may opt out of receiving such promotional emails from us by writing to us. You may also opt out of receiving emails and other messages from us by following the unsubscribe instructions in those messages. However, even if you have opted out of receiving information from us, we will still send non-promotional communications in relation to the Services.

Push Notifications: You can opt out of receiving push notifications through your device settings. Please note that opting out of receiving push notifications may impact your use of the App.

What is our data security practice?

We use requisite technical and organizational security measures to ensure a level of protection for personal data appropriate to the nature, scope and purpose of processing personal data, the risks associated with such processing, and the likelihood and severity of the harm that may result from such processing. The transfer of personal data between your end device and us is generally carried out via best-in-class encryption protocols. If you communicate with us by e-mail, access by third parties cannot be ruled out. In the case of confidential information, we recommend using the mail, i.e., post or encrypted e-mail communication (PGP). Internet security is a very dynamic issue. Hence, in cases where there is unauthorised access to or loss of data from the App due to "cyber vandals", viruses or other technical breakdowns resulting in the App being de-faced, presenting incorrect or inaccurate information, or experiencing downtime, we and/or Navi AMC will not be responsible.

Consent Mechanism:

By setting up an account on the App, you agree to our and Navi AMC’s processing, storage, usage, and sharing of the data provided by you pursuant to this Policy. If you do not agree with any of the terms of this Policy or the Terms or wish to revoke any consent you have provided to us and/or Navi AMC, please write to us at mf@navi.com. However, please note that if you revoke any mandatory permissions or revoke the consent to process and store information such as your Navi Account data, KYC Information and/or any other information needed to facilitate your investments, then we may have to cease the provision of Services to you.

Data Retention:

We shall retain the information you provide to facilitate your smooth and uninterrupted use of the App, and (i) to provide, improve and personalize our Services; (ii) to contact you about your account and give customer service; (iii) to personalize our advertising and marketing communications; and (iv) to prevent, detect, mitigate, and investigate fraudulent or illegal activities. We do not retain your personal data for longer than required for the purpose for which the information may be lawfully used. For any other information, we may entertain your request for deletion, however, you may not be able to use our Services at all after such deletion.

Children's Privacy

Our Services are not directed to children, and we do not knowingly solicit or collect personal information from persons under the age of 18 (eighteen). If we find out that a child has given us personal information, we will take steps to delete that information and terminate the relevant Navi Account.

Communications from Us

We may from time to time contact you via calls, SMS, emails, and other communication channels to provide you with information pertaining to our Services, notifications on updates vis-à-vis our Services (when we consider it necessary to do so), educational information and promotions. We may also notify you if we need to temporarily suspend the App for maintenance, and keep you informed on security, privacy, or administrative-related communications. By setting up an account on Navi, you consent to us contacting you via call, SMS, Whatsapp push notifications, or through any other communication channel, as we may deem fit.

Updates to this Policy

We may occasionally update this Policy. Use of our Services after an update constitutes consent to the updated notice to the extent permitted by law. Please take the time to periodically review this Policy for the latest information on our privacy practices.

Disclaimers and Terms of Use

The Navi Mutual Fund App is made available by Navi Technologies Private Limited (“our”, “us”, “we”, “Company”), having its registered office at 3rd Floor, Salarpuria Business Center, 93, 5th A Block, Koramangala Ind Layout, Bengaluru – 560 095, Karnataka, India, through which Navi AMC Limited (formerly known as Essel Finance AMC Limited) shall provide the Services to you to enable mobile based transactions in schemes of Navi Mutual Fund ("Mobile App") .

This page sets forth the terms and conditions ("Terms") applicable to the access and use of the Mobile App, for every person who download the Mobile App (hereinafter referred to as "User" or"they" or"their" or"you" or"your" ), and shall be applicable to all folios, which are existing or may be created at any time in future. You are requested to read these Terms carefully before you start using the Mobile App. By using the Mobile App you indicate that you have read, understood and accepted these Terms and have agreed to abide by the same without any limitation or qualification.

  • We reserve the right to modify these Terms at any time. Your continuing to use the Mobile App and availing of the facilities provided therein subsequent to modifications shall be construed as you having read, understood, and agreed to be bound by the revised Terms and shall constitute an agreement between you and Navi AMC Limited. These Terms shall always be read in conjunction with our Privacy Policy and the terms and conditions of the Scheme Information Document ("SID"), the Key Information Memorandum ("KIM"), and the Statement of Additional Information ("SAI") (hereinafter collectively referred to as Scheme Related Documents). If you do not intend to be legally bound by these Terms, including amendments thereto, please refrain from using the Mobile App.
  • Registration on the Mobile App:
  • Only Indian Resident adult individuals (with intended mode of holding/operation as single, who are eligible to invest in schemes of Navi Mutual Fund as per the terms of the Scheme Related Documents and are not restricted by any legal/regulatory/judicial/quasi judicial/other authority to invest, shall be eligible to directly register on the Mobile and avail of the online services available thereon.
  • If you choose to access the Mobile App from locations other than India, you shall do so at your own risk and you would be solely responsible for compliance with applicable local laws and regulations of such location/territory. We accept no liability whatsoever, direct or indirect, for non-compliance with the laws of any country other than the Republic of India. The mere fact that the Mobile App can be accessed through internet by you in a country other than India shall not be interpreted to imply that the laws of the said country govern these Terms and/or the use of the Mobile App.
  • Existing unitholder /investors of Navi Mutual Fund may, at any time, subject to these Terms, register on the Mobile App and avail of online facilities available thereon.
  • User hereby agrees to abide by these Terms and all applicable laws / rules / regulations in force and the changes thereto from time to time relating to the access to the Mobile App and/or the facilities made available thereon, including those relating to execution of transactions in Schemes of Navi Mutual Fund. The User further confirms that he is authorised, and is not restricted by any legal / regulatory / judicial / quasi judicial / other authority, to access the Mobile App and avail of the facilities offered thereon.
  • User shall be required to comply with KYC / CKYC (know your client/customer) requirements requirements under Prevention of Money Laundering Act, 2002 and such other applicable laws / rules / regulations as the case may be.
  • While enrolling for the Mobile App registration, the User shall be required to provide their PAN, Aadhaar Number, and such other information as may be prescribed from time to time under the Prevention of Money Laundering Act, 2002 and rules made there under as may be amended from time to time included SEBI, and such other applicable laws/regulations as the case may be. Based on the information provided, once it is ascertained that the User is KYC / CKYC verified verified and the other information provided by the User is in order as required by the applicable laws, the User will be allowed to register on the Mobile App. Subsequent to registration on the Mobile App, for the purpose of compliance with applicable laws/regulations, User may be required to submit such other documents as may be stipulated by the Registrar and Transfer Agent / Navi AMC Limited from time to time and the User hereby undertakes to submit such details/documents as and when required. The User further acknowledges that any failure to submit such documents/details may result in the User’s access to the Mobile App being suspended/ terminated.
  • The subsequent access to the Mobile App and execution of transaction(s) on the Mobile App, the User hereby provides consent in accordance with Aadhaar Act, 2016 and regulations made thereunder, for (i) collecting, storing and usage (ii) validating/authenticating and (ii) updating my Aadhaar number(s) in accordance with the Aadhaar Act, 2016 (and regulations made thereunder) and PMLA. User hereby provides consent for sharing/ disclosing of the Aadhaar number(s) including demographic information with the asset management companies of SEBI registered mutual fund and their Registrar and Transfer Agent (RTA) for the purpose of updating the same in User’s folios with their PAN.
  • User’s address as per KYC / CKYC records will be the registered address of the User in the records of Navi Mutual Fund.
  • User’s signature for the records of Navi AMC Limited in connection with availing of facilities on the Mobile App shall be retrieved / obtained from the KYC / CKYC. In case Navi AMC Limited is unable to obtain a clear image of the signature, User shall be required to submit a physical signature updation request to transact in schemes of Navi Mutual Fund through the physical mode.
  • All correspondence and/or delivery by Navi AMC Limited shall be made only at the address and/or email address available with Navi AMC Limited. We shall send communications/letters etc. to the User through courier/messenger/email/SMS or through any other valid mode at its own discretion and the User shall not hold Us liable for any loss and/or delay arising there from.
  • You hereby confirm that you shall not use the Mobile App for any illegal or improper purposes. We shall be authorized to immediately discontinue/suspend/terminate your access to the Mobile App upon being made aware of any such illegal or improper use of the Mobile App.
  • In order for you to be eligible for registration on the Mobile App and to transact on the Mobile App, you may need to have access to net banking facility/other online payment facility with the select banks having arrangements with us as per the list displayed on the Mobile App. You shall be required to register the account details on the Mobile App. It shall be your responsibility to ensure that the account details registered by you and the image of the cheque uploaded pertains to your bank account. In case of joint bank account, the User should be one of the joint holders of the bank account. In case it is found that the bank account details registered do not fulfil the above criteria, We shall reject the transaction requests and refund the amounts to the account registered on the Mobile App without any interest thereon, and We shall not be liable for any losses/damage sustained by the User on account of the above.
  • Minor investors: The Mobile App currently does not allow investments for and on behalf of the Minor.
  • Joint Holding: The Mobile App currently does not allow investments in joint names.
  • Scheme specific Portfolio holdings displayed on the Mobile App are as on month end data which has been released.
  • Scheme specific Risk-O-Meter is subject to change from time to time. The details are available on navimf.com .
  • Nomination: Subject to the terms contained herein, the Scheme Related Documents, and the applicable SEBI Regulations, nomination shall be mandatory for individual Users having a single mode of holding. Users who do not wish to nominate are required to confirm their non-intention to nominate. At present Nomination facility on the Mobile is available in limited manner. The User can also fill up the nomination form available on the Navi Mutual Fund website and submit the same in physical form to Navi AMC Limited office or any of the offices of its Registrar and Transfer Agent, Kfintech.
    Navi AMC Limited reserves the right to decide the type of services/facilities that may be offered on the Mobile App from time to time. There is no assurance by that all facilities available under the offline/physical mode shall be available to the User on the Mobile App. We may also make additions and/or deletions to the services and/or facilities that are currently offered on the Mobile App at its sole discretion.
  • The online facilities made available to the Users on the Mobile App shall be in addition to and not in substitution of the existing procedures or facilities for transacting in the Schemes of Navi Mutual Fund, including through offline / physical mode.
  • An application for any transaction on the Mobile App by the User does not automatically imply that We shall accept or process the same. We shall have the sole discretion of rejecting any request for any transaction on the Mobile App with insufficient/incorrect information and/or documents or for any other reason we deem fit, and our decision in this regard shall be final. We shall not be liable for any loss sustained by any User on account of such rejection. Further, We also reserve a right to seek additional information from Users for processing requests for transactions or otherwise on case to case basis.
  • Transaction request(s) made on the Mobile App may not be processed by Us till clear funds sufficient to cover the subscription price have been received by Us in the designated bank account and not upon the debit of funds from the account of the User.
  • The User hereby confirms that any amount utilised for transacting in the Scheme(s) of Navi Mutual Fund is / shall be through legitimate sources only and transaction executed by the User are not for the purpose of contravention and/or evasion of any act, rules, regulations, notifications or directions issued by any regulatory authority in India or in any other jurisdiction applicable to the User.
  • User understands and acknowledges that the responsibility of providing the correct information/details, including the contact information, amount, the bank account details, etc., lies solely with the User and Navi AMC Limited shall not be responsible to verify the accuracy of the information/details provided by the User. The User shall also be liable to inform Navi AMC Limited /Registrar and Transfer Agent of any change in any details or information provided initially. If any incorrect bank account number is provided by the User, any amount payable to the User could be credited to the wrong bank account so provided by the User and there is no guarantee of recovery of the same. The User shall take all care and caution to ensure that there are no mistakes and errors and that the information given to Navi AMC Limited is error free, accurate, proper, and complete at all points of time. The User confirms that Navi AMC Limited shall not be held liable for any loss or damage that may be sustained by the User on account of such error on the part of the User.
  • The User also confirms that, if the User receives any wrong credit of funds in his bank account from Navi AMC Limited, which does not belong to the User, on account of any reason whatsoever, the same shall immediately be returned to Navi AMC Limited / Navi Mutual Fund.
  • Any request for transaction on the Mobile App shall be time stamped consistent with the terms of the Scheme Related Documents. The Net Asset Value (NAV) applicable for purchase or redemption or switching of units shall be based on the time of the business day on which the application is received / completed on the Mobile App, and subject to the provisions of realisation of funds and cut off timings as described in the Scheme Related Documents of Navi Mutual Fund. Any transactions received/completed on the Mobile App after the cut off time as mentioned in the Scheme Related Documents shall be deemed to be received on the succeeding business day and shall be processed accordingly. The decision of Navi AMC Limited in this regard shall be final and binding on the User.
  • Transactions once placed on the Mobile App cannot be cancelled by the User other than as specifically allowed on the Mobile App.
General Terms:
Amendments:

These Terms may be amended or modified at any time and for such reason as Navi AMC Limited deems fit and proper including but not limited to comply with changes in laws and/or regulations, to correct inaccuracies, omissions, errors or ambiguities, reflect changes in the scope and nature of the services or based on User requirements

Suspension or Termination of facilities:

Navi AMC Limited may, at its sole discretion, suspend / disallow / modify / restrict all or any of the facilities offered under the Mobile App or deny access to the Mobile App to any specific User at any time and for such time period and for such reasons as it deems fit, including on account of inactive/dormant User ID, non compliance of the Terms, death, insolvency, or bankruptcy of the User, any restriction imposed by any legal/judicial/regulatory authority, or for any other cause arising out of the law/regulation or for such other reasons as we may deem fit.
Navi AMC Limited shall be entitled to withdraw or terminate all or any facilities offered under the Mobile App without assigning any reason whatsoever, without any prior notice to the User. We shall not be liable for any loss or damage that may be sustained by any User on account of such suspension / withdrawal / termination by Navi AMC Limited.

Disclaimer

Your use of the Mobile App shall be at your sole risk. The Mobile App has been provided on an “as is” and “as available” basis. Except as explicitly warranted in these Terms, we make no express or implied warranty with respect to the services/facilities provided on the Mobile App, including, without limitations, any warranties of uninterrupted/error free performance of the Mobile App, that any identified defects will be corrected, that the Mobile App is free from viruses or other malicious, destructive or corrupting code, non-infringement of third party rights, title, merchantability, data accuracy and completeness, satisfactory quality and/or fitness for a particular purpose.
The facilities offered on the Mobile App shall not constitute an offer to buy or sell or a solicitation to any person in any jurisdiction where it is unlawful to make such offer or solicitation.
Whilst every reasonable precaution has been taken to ensure the accuracy, security and confidentiality of data and information on the Mobile App, there cannot be any guarantee from internet frauds, hacking and other similar actions.
The Mobile App is controlled and operated by us from our offices in India. We make no representation that the Mobile App or the facilities offered on the Mobile App are appropriate or available for use in other locations or territories where their contents are unlawful and is prohibited. If you choose to access the Mobile App from locations other than India, you shall do so on your own initiative and you would be responsible for compliance with applicable local laws and regulations of such location/territory.

Liability

Navi AMC Limited shall not be liable for any damages or losses sustained by the User (direct and/or indirect) whatsoever, due to disruption or non-availability of the services/facility(s) under the Mobile App due to technical fault/error or any failure or failure in telecommunication network or any error in any software or hardware systems. br Navi AMC Limited / Navi Mutual Fund shall not be liable for any unauthorised transactions occurring through the Mobile App and the User hereby fully indemnifies and holds Navi AMC Limited / Navi Mutual Fund harmless against any action, suit, proceeding initiated against it or any loss, cost or damage incurred by it as a result thereof. Navi AMC Limited / Navi Mutual Fund shall under no circumstance be held liable to the User if the Mobile App or all or any part of the facilities on the Mobile App is not available in the desired manner for reasons including but not limited to legal restraints, faults in the telecommunication network or network failure, or any other force majeure events (such as flood, extraordinary weather condition, earthquake or other act of God, fire, war, insurrection, riot, labour dispute, accident, action of government, communications, power failure, equipment or software malfunction)or any other reason beyond the control of Navi AMC Limited / Navi Mutual Fund. Under no circumstances shall Navi AMC Limited / Navi Mutual Fund be liable for any damages whatsoever whether such damages are direct, indirect, incidental consequential and irrespective of whether any claim is based on loss of revenue, interruption of business or any loss of any character or nature whatsoever and whether sustained by the User or by any other person.

Interpretation:

The headings are used for convenience and ease of reference only and shall not affect the construction or interpretation of any provisions of these Terms;
The words, you, your, and User refer to the person(s) who access the Mobile App and shall include both singular and plural. Reference to masculine shall include the feminine and neuter gender.
Words and expressions used but not defined herein shall have the same meanings assigned to them in such Scheme Related Documents
In case of any conflict between the provisions of these Terms and the provisions of the Scheme Related Documents, the provisions of the Scheme Related Documents shall prevail;

Statutory details:

Navi Mutual Fund has been set up as a trust and is sponsored by Anmol Como Broking Private Limited (liability restricted to Rs. 1 lakh) with Navi Trustee Limited (Trustee under the Indian Trusts Act, 1882) as the Trustee and with Navi AMC Limited as the Investment Manager.
The word Navi MF appearing hereinafter shall mean "Navi Mutual Fund". All information in this App is provided on an "as is" basis, and without guarantees or warranties of any kind, express or implied. Furthermore, any ideas / information provided or gained from the App would not necessarily reflect the views of the Company, Navi AMC and/or Navi MF or any of its associates or subsidiaries or its directors or employees. The material / information available or obtained through this App is/are not guaranteed or warranted in terms of completeness, correctness, accuracy, reliability or otherwise howsoever by Navi MF. The information obtained at /or through this App is not and should not be construed as an offer document.
